Final Appeal: Dutch Government Makes Last Stand to Supply F-35 Parts to Israel

In a final legal stand, the Dutch government is arguing before the Supreme Court for its right to continue supplying F-35 fighter jet parts to Israel. The government is appealing a lower court’s ban, which was enacted due to concerns over how the jets are being used in the Gaza war.
The case has been a persistent challenge to the government’s authority since it was first filed in late 2023 by a coalition of human rights organizations. These groups have consistently argued that the shipments make the Netherlands a party to alleged war crimes, a claim the government rejects.
The legal turning point came in February 2024, when an appeals court ordered an immediate stop to the transfers. This decision forced the government into a corner, prompting a final appeal to the nation’s highest court on the grounds that the judiciary was interfering in matters of state.
In its final arguments, the government has reiterated that foreign policy is its exclusive domain. It has also highlighted the practical argument that the U.S.-owned parts would reach Israel regardless of a Dutch ban, making the court’s intervention a futile and potentially damaging gesture.
The Supreme Court’s decision is awaited with great interest, both domestically and internationally. The war in Gaza, which began with the Hamas attack of October 7, has created a politically charged environment, and the court’s ruling will be seen as a statement on the role of international law in constraining the actions of states during wartime.
